This document describes the agreement that you, the user, and we, Bauta Labs, the creators of Merlin Tutors, enter into when you sign up and generate a new account on Merlin Tutors.

1. Acknowledgement

   Bauta Labs grants you a revocable, non­exclusive, non­transferable, limited license to use Merlin Tutors solely for your personal, non­commercial purposes strictly in accordance with the terms of this agreement.

2. Privacy

   Merlin Tutors was developed so users could operate as publicly or privately as they choose. We take your privacy very seriously. Please read our Privacy Policy for full details.

3. Safety

   Merlin Tutors allows anybody to sign up and post content of their own choosing. You understand that by using Merlin Tutors, you may encounter content that may be deemed offensive, indecent, or objectionable, which may have explicit language, and that the results of any search may automatically and unintentionally generate links or references to objectionable material. Nevertheless, you agree to use Merlin Tutors at your sole risk and that Bauta Labs shall not have any liability to you for content that may be found to be offensive, indecent, or objectionable.

   Merlin Tutors includes blocking, post reporting, and user reporting buttons. Should you encounter material you deem to be indecent, you may report the particular post in which the material appears, you may report the user or domino that made the post, and you may block the user or domino that made the post.

   Merlin Tutors will act upon all user reports within 24 hours. If we deem the material to be inappropriate, the content will be removed and the user will be deleted from Merlin Tutors. Merlin Tutors reserves the right to remove any user-generated content it chooses, and eject any user it chooses, at zero notice.

4. Mobile and Other Devices

   Merlin Tutors is available as an app and can be downloaded from various online app stores, including Apple’s App Store and Google Play. Should you install the app on your mobile device, you agree to abide by the terms laid out in that store’s documentation. The App Store End User Licence Agreement can be viewed here: App Store EULA. 5. Cookie Policy

   Merlin Tutors cannot function without placing cookies on your browser. By using Merlin Tutors, you agree that Merlin Tutors may place cookies on your browser.

6. Restrictions

   You agree not to, and you will not permit others to license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit Merlin Tutors or make Merlin Tutors available to any third party.

7. Modifications

   Bauta Labs reserves the right to modify, suspend or discontinue, temporarily or permanently, Merlin Tutors or any service to which it connects, with or without notice and without liability to you.

8. Term and Termination

   This Agreement shall remain in effect until terminated by you or Bauta Labs. Bauta Labs may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice. This Agreement will terminate immediately, without prior notice from Bauta Labs, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting Merlin Tutors and all copies thereof from your mobile device or from your computer. Upon termination of this Agreement, you shall cease all use of the Application and delete all copies of the Application from your mobile device or from your computer.

9. Severability

   If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

10. Amendments

    Bauta Labs reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material we will provide at least 7 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

11. Limitation of Liability

    To the extent not prohibited by law, in no event shall Bauta Labs be liable for personal injury, or any incidental, special, indirect or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruption or any other commercial damages or losses, arising out of or related to your use or inability to use Merlin Tutors, however caused, regardless of the theory of liability (contract, tort or otherwise) and even if Bauta Labs has been advised of the possibility of such damages. Some jurisdictions do not allow the limitation of liability for personal injury, or of incidental or consequential damages, so this limitation may not apply to you.
